Amendments to Russian Legislation on Water Resources
Regulations Governing the State Water Register Keeping shall be taken into account before entering into a contract of water use in Russia (e. g. fishery).
Under Russian Water Code (came into force on January 1, 2007) the State Water Register is a collection of documented information on the water objects available in the federal property, property of the subjects of the Russian Federation, municipal formations, natural persons and legal entities and independent entrepreneurs, on the use of water objects, on river basins and basin districts (art. 31).
New Regulations Governing the State Water Register Keeping were enforced by Decree of the Government of the Russian Federation No. 253 of April 28, 2007. The form of the Register and the rules of entry of information in it, as well as the rules of drawing up of the registration in the Register, are endorsed by the Ministry of Natural Resources (on the analogy of the United States Department of the Interior).
In accordance with the Regulations, the State Water Register embodies (1) state registration of contracts of water use, discharge of contracts, usufructs, transfer of titles, and (2) water cadastre. Inventory of water resources was made under Water Code of 1995 (art. 79) and shall be included in State Water Register. Regulations Governing the State Water Register Keeping do not deal with licensing; new Russian water legislation abolished the requirement of obtain a Water Operator license.
